Every employer in Scotland is responsible for carrying out a suitable assessment of the workplace for the purpose of identifying risks to the safety of employees and take all necessary fire safety measures in relation to the workplace. (Reference: Fire (Scotland) Act 2005, Article 53)
The Employer is normally the one responsible for ensuring a fire risk assessment has been carried out however it may be that of the person who has control to any extent of the premises (Reference: Fire (Scotland) Act 2005, Article 54).
